FREMONT COUNTY, Idaho (KMVT/KSVT) — Chad Daybell appeared before a judge on Wednesday after his attorney asked for his grand jury indictment to be dismissed.

Daybell is facing first-degree murder charges in the deaths of his wife Lori Vallow’s children JJ Vallow and Tylee Ryan, as well as the death of his first wife Tammy Daybell.

He is additionally facing murder conspiracy charges related to those victims.

In the hearing, defense attorney John Prior argued the jurors selected were “not impartial.”

The court will issue a written decision on this motion at a later date.

Earlier this week, a judge denied his request to separate his trial from that of his wife Lori Vallow. Daybell faces the death penalty. The trial is set for January 2023 in Boise.
